Terms of Service

These Terms of Service govern your use of DAIRX and its associated services. We've written them to be clear and fair. By using DAIRX, you agree to these terms.

1. What DAIRX Is

DAIRX is a GPU compute platform. We operate a global network of datacenter partnerships, providing real-time pricing, availability, and specifications through a single interface. When you deploy a GPU through DAIRX, we route your request to the optimal infrastructure based on your configuration.

Your compute instances run on third-party datacenter infrastructure managed through our network. We handle discovery, provisioning, monitoring, and billing — you get a single platform experience without managing multiple accounts or relationships.

2. Your Account

You need an account to use DAIRX. Authentication is handled by Clerk, a third-party identity provider. You're responsible for keeping your account secure and for all activity under your credentials.

  • You must be at least 18 years old
  • Provide accurate information when registering
  • If acting on behalf of an organization, you confirm you have authority to bind them
  • Notify us immediately if you suspect unauthorized access

3. Billing & Payments

All payments are processed through Stripe. We never see or store your full card number, CVV, or billing address. Stripe holds PCI DSS Level 1 certification — the highest level of payment security.

  • Charges are based on actual GPU usage at the hourly rate shown before deployment
  • You authorize charges to your payment method when you deploy resources
  • Pricing is always displayed before you confirm any deployment
  • You can set budget limits and runtime caps to prevent unexpected charges
  • Failed payments may result in resource suspension until resolved

If the infrastructure fails to deliver the resource you paid for — deployment failure, immediate crash, or non-functional hardware — you will receive a full refund for the undelivered compute time. No questions asked.

For partial delivery scenarios (e.g., an instance that ran successfully before experiencing an issue), refunds are handled on a case-by-case basis.

4. Acceptable Use

DAIRX is built for machine learning, AI research, data science, and general compute workloads. You agree not to:

  • Use resources for illegal activity or to violate any applicable law
  • Attempt to gain unauthorized access to underlying infrastructure
  • Interfere with other users' access to the platform
  • Overload or create resource contention on provisioned instances beyond their allocated capacity
  • Engage in deceptive activity or misrepresent your identity

Violations may result in immediate account suspension. Datacenter partners in our network may also enforce their own acceptable use policies on their infrastructure.

5. Your Data Stays Yours

Everything you create on DAIRX-provisioned resources — models, datasets, notebooks, code — belongs entirely to you. We claim no ownership or license over your work.

We process your configuration data (GPU preferences, deployment settings) solely to operate the service. We do not access, inspect, or use the content running on your compute instances.

6. Infrastructure Partners

When you deploy through DAIRX, your instance runs on datacenter infrastructure operated by our network partners. Each datacenter has their own terms of service and acceptable use policies. By deploying through DAIRX, you also agree to comply with the terms of the underlying infrastructure.

We vet every datacenter in our network for reliability, but we do not control their physical infrastructure. If a datacenter experiences downtime or hardware failure, we will assist you with redeployment. If the failure means you paid for compute that was never delivered, our refund guarantee in Section 3 applies.

7. Service Availability

We work to keep DAIRX available and performant. We do not offer a formal SLA at this stage, but our infrastructure is built on Vercel and Cloudflare — both of which provide enterprise-grade uptime. The platform may be temporarily unavailable for maintenance or updates — we will provide advance notice when possible.

GPU availability depends on datacenter capacity across our network and fluctuates based on market demand. DAIRX shows real-time availability but cannot guarantee that a specific GPU will be available at any given time.

8. Limitation of Liability

DAIRX is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted service, specific performance levels, or compatibility with all workloads.

To the maximum extent permitted by law, DAIRX shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunity. Our total liability is limited to the fees you paid us in the twelve months preceding the claim.

9. Termination

You can close your account at any time. Active resources will be terminated and any outstanding charges billed to your payment method. Your personal data will be deleted within 30 days of account closure, except where retention is required by law.

We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to the platform or its users. We will notify you where feasible.

10. Changes to These Terms

We may update these terms as the platform evolves. Material changes will be communicated via email or through the platform. Continued use of DAIRX after changes take effect constitutes acceptance of the updated terms. If you disagree with any change, you may close your account.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
